Privacy Policy

This Privacy Policy outlines the practices and procedures regarding the collection, use, and sharing of personal and marketing data at the point of sale (POS) machines in accordance with applicable Canadian and provincial privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) as well as any other applicable laws. 

  1. Introduction

Welcome to our website (the “Site”) operated by Silk & Snow Inc. (the “Company”). We value our customers and respect your privacy. We recognize that we must maintain and use your personal information responsibly. We have created this privacy policy (the “Policy”) to demonstrate our firm commitment to your privacy and security and to advise you about the collection, use and disclosure of personal information provided in-store, by mail or at the Site. The Policy also allows you to “opt-out” of providing personal information you do not wish to provide and to access, change or remove any personal information already collected. The Company will not collect, use or disclose your personal information other than in compliance with the Policy.

By providing any personal information during visitors’ and customers’ visits to the Site and/or visits to the Company’s stores and/or by accessing and using the Site or the Company microsites used in connection with contest and promotional offers, you thereby agree to all of the terms and conditions of the Policy and consent to the collection, use and disclosure of your personal information as described in the Policy. You are responsible for ensuring that your access to the Site and the material available on or through it is legal in each jurisdiction in or through which you access or view the Site or such material.

The terms “we”, “us”, and “our” used in the Policy refer, collectively, to the Company and its affiliates, divisions, successors and assigns and their respective employees, mandataries and agents (collectively, the “Company Affiliates”).

  1. Information We Collect

Any time you place an order, enter a contest, complete a ballot, or introduce or post any text, image, video, audio, or any information, content or other materials through the Site, at a store or any other Company website including any of the Company’s social media websites and web pages such as Facebook, Twitter or YouTube, or otherwise provide personal information to the Company (including via mail or e-mail in regular correspondence), it is collected, used and disclosed by the Company for various purposes as described herein. Moreover, every time you visit the Site, the following information is automatically obtained and compiled: your internet protocol (IP) address and the domain name registry information associated with that IP address; identification of your internet browser, operating system and hardware platform you are using; the date and time of your visit; the name and address (URL) of the web page you viewed immediately before accessing the Site; your entire query (if any) that was entered into any search engine which led you to the Site; and any other “click stream” data. This information is stored in our log files. Occasionally, if your browser is not configured to prevent disclosure of such information, the following information may also be revealed: your name, e-mail address, home and work addresses, telephone and fax numbers and any plain text commentary.

Additionally, we collect a complete record of your actions on the Site, including all pages visited, the time spent on each page, the information sent or received, and the names of all files uploaded or downloaded. We may compile this tracking information in the aggregate and make it available to third parties primarily to identify demographic data regarding our customers.

On our website or at our point-of-sale machines, we collect the following categories of information:

  • Personal Information: This may include but is not limited to your name, address, email, phone number, and payment details (such as credit or debit card information).
  • Transaction Data: Information related to your purchase, including products purchased, transaction amount, time, and payment method.

In light of the importance of protecting children’s privacy, we do not intend the Site or retail locations to be for child audiences. We do not collect, process or use on the Site any information relating to an individual we know to be under 13 years old without the prior, verifiable consent of his or her parent or other legal representative. If a parent or guardian discovers that their child has provided us with personally identifiable information, such parent or guardian has the right, upon request, to view the information provided by the child and/or to require that it be deleted from our records. In such a case, we ask that the parent or guardian of the child contact us using the contact information provided in the “Contacting Us” section below for such purpose.

We use the information collected from the point of sale in the following ways:

You acknowledge and agree that the Company shall also have the right to incorporate, use and reproduce any text, image, video, audio, or any information, content or other materials you provide through the Site by e-mail or post through the Company’s social networking websites and web pages such as Facebook, Twitter or YouTube, in whole or in part, in connection with the marketing and promotion of the Company’s business. You always have the right to revoke such consent in the manner described in the section “Your rights” below.

Under PIPEDA and other applicable laws, we require your consent to collect and use your personal and marketing data. When you interact with the POS system, you consent to collecting and using your information as described in this Privacy Policy.

For marketing communications, we will obtain your express consent before sending you promotional materials. You may withdraw your consent for marketing communications at any time by opting out through the unsubscribe link provided or contacting us directly.

  1. Sharing Your Information

We may share your personal information and marketing data with:

WHILE WE STRIVE TO PROTECT YOUR PERSONAL INFORMATION, WE CANNOT ENSURE OR WARRANT THE SECURITY OF ANY INFORMATION YOU TRANSMIT TO US. WE HAVE IMPLEMENTED ADEQUATE TECHNICAL AND ORGANIZATIONAL MEASURES TO PROTECT YOUR PERSONAL DATA AGAINST UNAUTHORIZED, ACCIDENTAL OR UNLAWFUL DESTRUCTION, LOSS, ALTERATION, MISUSE, DISCLOSURE OR ACCESS AND AGAINST ALL UNLAWFUL FORMS OF PROCESSING.

We will retain your personal and marketing data only for as long as necessary to fulfill the purposes outlined in this Privacy Policy or as required by applicable law. Once the data is no longer needed, it will be securely destroyed or anonymized.

  • Complaint: If you have concerns about our privacy practices, please contact us directly and we will work diligently to promptly address your concerns. Under federal law you also have the right to file a complaint with the Privacy Commissioner of Canada.

There may be situations where we cannot grant your request — for example, if you ask us to delete your transaction data, we are legally obligated to keep a record of that transaction to comply with the  law. We may also decline to grant a request when  doing so would undermine our legitimate use of data for anti-fraud and security purposes, such as when you request deletion of an account being investigated for security concerns. Other reasons your privacy request may be denied are if it jeopardizes the privacy of others, is frivolous or vexatious, or would be highly impractical or unreasonable.

If applicable, we may use cookies and other tracking technologies to enhance your experience when interacting with our POS systems. These tools help us analyze trends, track user behavior, and customize content. You can manage cookie preferences through your browser settings.
